APPLICATIONS UNDER THE 42nd CLAUSE OF THE LAND ACT.
On Friday Mr Clement Hodgkinson, assistant surveyor, and Mr J. H. Taylor, district Government surveyor, sat as a commission at the District Survey Office to consider applications for land under the 42nd or occupation license clause of the Amending Land Act. HUNTLY POLICE COURT.
Wednesday, 11th May.
(Before Mr J, Cogdon, P.M, and Messrs Britt and Clay. J.Ps.)
Assaults,-Bridget Malonoy charged M. Coyle with having assaulted her on Sunday, by first knocking her down and then jumping on her and putting his knee on her chest, Mr Wrixon appeared for the defendant, and Mr Rymer for complainant. The evidence was very conflicting, there being also a cross case of assault, and the Bench thought the best thing to do would be to dismiss the cases, and accordingly the parties wore nonsuited,-Robert Cole charged Marantelli, an Italian, with having on the 29th April assaulted him by knocking him down and then jumping upon him. There was also a second charge of damaging his property, but both cases were heard together. Mr Strickland appeared for defendant, and Mr Rymer for complainant. Robert Cole deposed that defendant and another man came into his place on the night in question at about half-past eight o'clock, and called for brandy, which was refused to them, as his wife had a slight suspicion that they were " informers." She called out for witness, and he came out and told defendant to go, at the same time he gave him a kick and put him out. Defendant then rushed into the house, took complainant clean off his legs and jumped on him. Defendant then broke the windows with his hands. Cross examined by Mr Strickland: Could swear positively that he never used his hands to put defendant out; saw him run his fists through the window. Mrs Cole was then called, but merely corroborated the previous witness's statement. For the defence Mr Strickland called J. Lennan, who deposed that he was with defendant on the night of the 29th April. They both went into Mr Cole's and asked for drinks, which were refused them, and Mr Cole then came forward and told defendant to go out, at the same time he pushed defendant out. He was sure that hands were laid on defendant to put him out. The Bench considered that provocation had been given for the assault, and they would dismiss defendant on that charge, but they thought that he was not justified in rushing back and breaking the window, and therefore fined him 40s, compensation 3s, and 40s costs.

INQUEST.
TEE MYSTERIOUS DEATH AT HUNTY.
The district coroner held an inquest yesterday, at the house of James Lennon, Lower Huntly, on the body of Robert Cole, aged seventy-four, who was found dead in the Bendigo Creek on the previous day.
William Adams Cheyne, surgeon, deposed that he had known the deceased, Robert Cole, for a number of years. He was a man of sober habits. Witness had examined the body, and found it well nourished. Within the chest both lungs were enormously congested, and contained but little air.
There was no blood nor serum effused into either cavities of the chest. The cause of death witness believed to be from exhaustion, consequent upon acute inflammation of the lungs and bowels. There was no probability deceased was drowned. Witness was of opinion that the inflammation of the lungs and bowels was brought on by the inclement weather at his time of life. The deceased would be likely to die suddenly from those causes, exposed as he was, and alone. Had be had assistance he might have been restored.
George Cole, son of the deceased, gave evidence that his father was 74 years old, and enjoyed good health up to his leaving home on Wednesday, 26th instant. The deceased was going to put up a stable about a mile and a quarter from his own home. Witness saw his father leaving home standing up in the dray as he drove off alone. The mare was a steady one unless frightened, and was quiet in any way. Deceased had had her for sixteen months. Deceased did not return home on Wednesday night, and on Thursday witness's brother told him he had been found dead. Deceased had his dinner with him, but it was found untouched.
Robert Cole, another son of deceased, stated that when he returned home about seven o'clock on Wednesday evening his mother asked him if he had seen the deceased (his father). Witness replied in the negative, and witness and Thomas Cole went in search of the deceased, but could not get any trace of him that night. Witness at about six o'clock on Thursday morning again went in search, in company with another, and about three-quarters of a mile from where deceased had been cutting the young tree they found the dray on its side, the wheel up, the shaft- broken, and the mare quite dead. Marks of her Struggles were there, and it appeared as if she had killed her self trying to get away. They continued searching for the deceased, and a Mrs Prendergast told them that John Hood had found him dead at the Bendigo Creek. Witness believed that his father died where he was cutting the young tree, and that his body was washed by the rain to where Mr Hood found it. Heavy rain came on on Wednesday evening, whilst witness was searching for the deceased, causing witness to give up the search, as he could see nothing for the rain and Storm.
John Hood miner gave evidence that about four o'clock on Wednesday afternoon, the 26th instant, he was driving cattle, and when Crossing the Bendigo Creek, saw a horse and dray standing quietly on the bank. On witness's return home at eight in the evening, he heard that the deceased was missing, and, next morning, hearing that he had not returned home, and that search was being made for him, witness thought of the horse and dray, and went immediately to the creek and found the body about three yards from the channel at the creek. It lay in a channel formed by the creek when over flooded. The body had caught against some saplings, or else it would have been carried away by the flooded creek. The channel was then dry. The clothes were covered with mud and leaves, showing the body had been carried down by the flood some 100 yards from where the deceased had been cutting a tree, at which witness found the deceased's axe, and the sapling partly cut.
The jury returned a verdict that the deceased died suddenly between nine and eleven o'clock, on the 26th July, at a tree he had been cutting down at the Bendigo Creek, Huntly, and that he died from exhaustion consequent upon inflammation of the lungs and bowels, accelerated by exposure to the cold on that day.
